Arrest History in Henderson County
Henderson County Sheriff deputies make arrests in county jurisdiction, but city police departments in Athens, Gun Barrel City, Malakoff, Chandler, and other incorporated places keep the reports they create. Ask which agency made the arrest before requesting the offense or probable-cause report.
The Henderson County jail creates an intake record when it receives a person. That record is distinct from the officer's narrative and from a filed criminal case. Fingerprints and transaction data can support later reporting to the Texas Department of Public Safety Computerized Criminal History system. A magistrate produces warnings, probable-cause, counsel, and bail records. The prosecutor then decides whether and what to file.
Henderson Arrest Charges Can Change

The official custodian decides which fields are public. A missing photo, officer narrative, or release field may reflect policy, redaction, or portal design rather than a missing arrest.
Henderson Arrest Magistration Timeline

Henderson County's 2023 Fair Defense Plan also describes probable-cause paperwork at booking and statutory bond or release treatment when probable cause in a warrantless arrest is not determined on time. The 48-hour mark does not promise release. It sets the ceiling for the initial magistration step, not the deadline for a prosecutor to finish the case.

Henderson Bookings Reach DPS Later
Fingerprint-supported arrest transactions can flow from booking to the Texas DPS Computerized Criminal History repository, but public CCH is not designed as a live Henderson County booking feed. The prosecutor and clerk must also create and report later case data before a disposition can attach to the arrest cycle.

If the portal is unavailable, call the jail information line for current local custody and make a focused request for an existing booking record. Do not replace an official outage with a commercial mugshot or people-search service.
Sheriff monthly statistics add scale but do not name arrestees. April 2026 reported 76 arrests, 325 average daily inmates, 281 admissions, and 305 releases. The same report listed 493 warrants received and 376 served or recalled. Those figures are a one-month operational snapshot. “Served or recalled” is not the same measure as warrant arrests.
Current or recent rosters can change after release or transfer. A missing entry is not proof that no arrest occurred, and the arresting agency can still hold its report after a person leaves the jail.

Request Henderson Arrest Records Correctly
An arrest inside Henderson County does not make the Sheriff the custodian of every report. Athens police records belong with Athens PD. Gun Barrel City police reports route to that department, and a trooper's crash or arrest report follows the DPS public-information process. The county jail may still hold a booking record when it received the person, but that file does not replace the arresting officer's narrative.
Under the Texas Public Information Act, request an existing record instead of asking the agency to answer a legal question or create a new report. Henderson County's official public-information request route is another county fallback. Active-law-enforcement material and confidential juvenile, victim, medical, biometric, motor-vehicle, or identifying data can be withheld or redacted under applicable law.
Arrests vs Convictions
The arrest record and the conviction record are made at different stages. A Henderson County booking can end in release without charges, dismissal, deferred adjudication, acquittal, or conviction. Only the court's judgment and disposition establish how a filed count ended.
